Whether you use a REALTOR or go it alone, I highly recommend using a real estate attorney. They can review documents, ensure compliance, and protect your interests.

4. Escrow company: The buyer will have an attorney or title company close on the home. You will need to be in close communication to get the house closed promptly.  Respond to all requests immediately.

5. Home Stager: Consider hiring a home stager to help prepare your home. The few hundred dollars it costs can reap your thousands in the end.  A home stager knows how to present your FSBO home to appeal to a broad buyer base.

If you decide to sell your house on your own, consult with an attorney so you can fully understand the legal issues involved as a For Sale By Owner. Ignorance does not exonerate you from your legal responsibilities when selling a home without a REALTOR.  Here are some areas to consider:

Disclosure Laws- What you are required to disclose to potential buyers varies significantly from state to state.  In Massachusetts, a homeowner is not obligated to reveal anything about the property except for a few things.   What must be disclosed is if a private sewer system services the home, whether the property has lead paint or not and finally, you must answer all questions honestly presented by a home buyer.

Fair Housing Laws- There areprotected classes in Massachusetts that, as an FSBO seller, you should be aware of.  You violate fair housing laws if you refuse or try to discourage a protected class member from buying your home. 

But what you say can come back to haunt you.  Benign statements can be turned on you and misconstrued by a potential buyer as violating fair housing laws. The best practice is to talk about the home, not people looking at our home or your neighbors.

Contracts- The sale of a home can be a complex legal transaction.  Real estate contracts are legal and binding and give you specific responsibilities as a seller.  I highly recommend hiring a real estate attorney representing your best interest in a real estate transaction.

Inspections- Depending on the state and even the city you are in, there may be inspections required before you close.  In Massachusetts, a seller must have a passing Title V for a private septic system.  In addition, a seller must provide a certificate of compliance for the home’s smoke and carbon monoxide detectors.

Representations- The accuracy of your statements about your home is essential so it does not come back to bite you.  Do not make any representations about a home that you are not 100% certain of. For example, sellers always want to say with certainty where their property lines are, but without finding the boundary markers, you cannot say with definitiveness where they are.  Or, overstating the square footage of your home without verifying with tax records or a proper measurement.  Sometimes I don’t know is the best answer. 

Surveillance: Technology has made in-home surveillance cheap and easy. Many sellers have nanny cams and security cameras to capture video and audio if home buyers going through a home.  It is a felony in Massachusetts to monitor or record audio of a party that has not consented.  State laws vary throughout the United States…. know the laws for your region.

Over the years I have been involved with many For Sale By Owner transactions.  I am either brought in to clean up a mess, or a seller is honest up front with me and tells me they want to try and sell on their own.  Me, I say that great and tell them I am happy to be a resource during the process.  
 
I compiled a list based on my experience with FSBO owners and here’s a quick list of what I believe a seller who is going it alone needs to know to successfully sell a house without a REALTOR.
  1. Know Your Competition- As a For Sale By Owner Selling a home, it is critical to know your competition. Learn what similar-priced homes have very recently sold for, as well as what is on the market.  Remember, your house is competing; a buyer who rejects your home doesn’t stop their home search.  They buy another house they perceive is a better fit and a better value.
  2. Remove The Emotion- When selling your home, managing your emotions is essential, as they can lead to poor decision-making. Being emotionally attached to your home can cloud your judgment, potentially resulting in accepting a lower offer or rejecting a good one.
  3. Take The Home Out of Your House- It is essential to remember that you are selling a house for a buyer to make it their home. You are not selling your home.  It is essential to declutter, de-personalize and neutralize your home.  The more generic you make it, the better.  For example, if I see a dining area with a huge oriental rug and heavy drapes, I will often ask to remove them before showing a home.  Show off what a buyer is buying: your hardwood floors and the natural light flooding the windows.
  4. Know What Today’s Buyers Want- Unfortunately, not everyone will love the things you love about your home. As an owner going it alone, you can over-emphasize the things you love that don’t matter to most home buyers, like the owner who had the soundproofed basement or the house with the hot tub smack dab in the middle or the family room, or the 17×45 foot deck that just cost you $120,000.
  5. The Importance of Leveraging The Internet- Realize today’s buyers hide behind their phones or computers until they are compelled to view a home in person. You need high-quality images and lots of information about your home.  It is essential as a FSBO seller to expose your home to as many potential buyers as possible.
  6. When A Buyer Loves A Home, They Make An Offer Immediately- I have been involved in many For Sale By Owner transactions for sellers who have gotten over their heads. I invariably hear the seller say I have an offer coming from a buyer. Two weeks later, they are still waiting for that offer.  In my world as REALTOR buyers don’t wait too make offers.  They love it and they immediately start the negotiations.
  7. FSBOs Attract A Certain Buyer- Listing your home as a FSBO attracts several types of buyers to be aware of. There is the buyer hoping you don’t know what you are doing that wants to steal your home. Then there is the buyer who wants to save on buying a home and is looking for that same 4 to 6% in commissions you are looking to save.  The dreamer who can’t buy a home that has been vetted by an agent and deemed as a time waster.  And finally, you will get buyers who are actually willing and able to buy your home.  Just be aware of the time wasters.
  8. Selling A Home Means More Than Sticking A Sign In The Ground- Successfully selling a home for full market value takes a carefully crafted plan. Unless you are on a super busy street, you need to structure a marketing plan to get your home sold.  I once had a listing I sold for $360k. At the same time, another agent sold the identical stand-alone condo for $345k, and an FSBO sold for $323k, and it took an entire year to sell.  They could have paid me a 6% commission and still pocketed an extra 19k.  So, what is the difference?  Marketing and exposure to the home.
  9. The Low Ball Offer- It is important to consider each offer carefully and remove your emotions. It’s quite possible you will get low ball offers.  And, your first reaction will bee to go take a hike.  But in my experience, some buyers are going to try.  My suggestion is to counter, no matter what.  Offer them $500 off the purchase price in good faith.  State your position and possibly point out comparables that support the market value is of your house.  See what they do.  If they are trying to nickel and dime you on their next counter cut them loose.  But, I will tell you often they will make a significant jump.
